These regulations constitute the rules for the conclusion of distance sales contracts concluded through the Shop.
DEFINITIONS
Consumer - a natural person making a legal transaction with the Entrepreneur within the framework of the Market 95 shop which is not directly connected with his/her economic or professional activity

User - any entity making purchases through the Shop.

The Consumer can communicate with the Entrepreneur via the addresses and details given in this paragraph.
INTRODUCTORY INFORMATION
The prices given in the Shop are given in Polish zloty and are gross prices (including VAT).
The final price of the order consists of the price for the goods and the cost of delivery indicated on the Shop's pages.
PERFORMANCE OF THE SALES CONTRACT
The User should pay the Entrepreneur for the purchased goods within 14 days or upon delivery of the goods - depending on the payment method chosen when placing the order.

RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
The period of withdrawal shall expire after 14 days from the day on which the consumer acquires possession of the goods or on which a third party other than the carrier and indicated by the consumer acquires possession of the goods.
In order to exercise the right of withdrawal, the Consumer must inform the Entrepreneur of his/her decision to withdraw from the contract by an unequivocal statement - using the Entrepreneur's details provided in these terms and conditions.
The consumer may use the model withdrawal form at the end of these terms and conditions, but this is not obligatory.
In order to comply with the withdrawal period, it is sufficient for the Consumer to send information concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal:
in the event of withdrawal from a contract, the Trader shall reimburse to the Consumer all payments received from the Consumer, including the costs of delivery (with the exception of: the additional costs resulting from the manner of delivery chosen by the Consumer other than the least expensive ordinary manner of delivery offered by the Trader in the Shop), immediately and in any event not later than 14 days from the day on which the Trader
has been informed of the consumer's decision to exercise his right of withdrawal;
the reimbursement shall be made by the Trader using the same means of payment as those used by the Consumer in the original transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer shall not incur any fees in connection with such reimbursement;
The trader may withhold reimbursement until he has received the goods or until he has been provided with proof of their return, whichever event occurs first;
The Consumer should send back the goods to the address of the Entrepreneur given in these terms and conditions immediately, and in any case no later than 14 days from the day on which he or she informed the Entrepreneur of his or her withdrawal from the contract. The deadline will be met if the Consumer sends back the goods before the expiry of the 14-day period;
The consumer shall bear the direct costs of returning the item;
The consumer shall only be liable for any diminution in the value of the item resulting from the use of the item other than what was necessary to establish the nature, characteristics and functioning of the item.
If, due to their nature, the items cannot be sent back in the usual way by post, information about this, as well as the costs of returning the item, will be included in the description of the item in the Shop.
complaints and warranty
The trader is obliged to deliver an item free of defects.
In the event of a defect in goods purchased from the Entrepreneur, the Consumer is entitled to make a complaint based on the warranty regulated by the Civil Code.
Complaints must be made in writing or electronically to the Entrepreneur's addresses set out in these terms and conditions.
It is advisable to include in the complaint, among other things, a brief description of the defect, the date on which it occurred, the details of the Consumer making the complaint and the Consumer's request in connection with the defect in the goods.
The trader shall respond to the Consumer's complaint request within 14 days, and if the trader fails to do so within this period, the trader shall be deemed to have acknowledged the Consumer's request.
Goods sent back under the complaints procedure should be sent to the address specified in § 3 of the Terms and Conditions.
If a product has a guarantee, information about the guarantee and its content will be included in the product description in the Shop.

The consumer has the opportunity to benefit from, among other things:
mediation by Provincial Trade Inspection Inspectorates.
the assistance of permanent amicable consumer courts operating at provincial inspectorates of trade inspection
PERSONAL DATA
When making a purchase in the Shop, the User voluntarily provides his/her data, which are necessary for the fulfilment of the order and will be processed by the Entrepreneur for this purpose.
The user has the right to inspect and request the rectification of personal data concerning him or her.
The administrator of the personal data is the Entrepreneur.
FINAL PROVISIONS
In matters not covered by these terms and conditions, the generally applicable provisions of Polish law shall apply, in particular: the Consumer Rights Act of 30 May 2014, the Civil Code Act of 23 April 1964 and the Civil Procedure Code Act of 17 November 1964.
A contract of sale concluded on the basis of these terms and conditions concerns a specific order and is concluded for the purpose of fulfilling a single order. Each order requires separate acceptance of the terms and conditions.
